Breath / Blood Tests
Texas DWI law requires the DWI suspects to undergo the following tests in order to test their alcohol concentration in the blood:
Blood testing
This is considered as the most reliable and accurate method of determining a person’s alcohol concentration by the scientific community. However this is most undesirable and inconvenient method for police. This type of testing consents the Texas DWI convict to get the blood sample retested by their own expert for accurate results.
Breath testing
The scientific community is hesitant on the reliability and accuracy of this test, while police treat this to be the most convenient form of testing. In this type of testing, the breath samples are not stored for a retest to verify the accuracy of the 1st time test results.
Urine testing
This is the least accurate & reliable method of testing and is rarely conducted on the Texas DWI convicts.
Refusal of doing the tests can result in the following Texas DWI Penalties:
- A180-day suspension of your driving privilege if this is your first Texas DWI arrest.
- A 2-year suspension of your driving privileges for a subsequent arrest within 10 years if you refused to submit to a test in your first arrest.
If you fail the test subjected during the charge of Texas DWI, the consequences could be:
- A 90-day suspension of your driving privilege if your driving record shows no prior Texas DWI arrests.
- A 1-year suspension of your driving privilege if you have a prior conviction or suspension with the preceding 10 years.
