Arrest Process


This section explains the step-by-step processes that happens after a Nevada DUI/DWAI arrest.

  1. Motor Vehicle Hearing: In order to save your driving privileges after the Nevada DUI conviction, you need to make an appeal with in 7 days after your license has been taken away or with in the time frame set forth by the DMV in a revocation letter.
  2. Arraignment: This refers to a date, about 30-90 days after you have been arrested. This is when you will be advised of your rights as per the laws of Nevada DUI. An attorney can appear on your behalf.
  3. Pre-trial Conference: This happens after the arraignment when your Nevada DUI attorney will negotiate a plea bargain with the district attorney. The date is set by the court and your attorney on his calendar.
  4. Suppression Hearing: This happens anytime between 6 weeks to 3 months after the pre trial conference. At this stage, your Nevada DUI attorney will file a motion to suppress.
  5. Trial: According to the Nevada DUI laws, you are not entitled to a jury trial for misdemeanors. In case you are charged with a felony DUI then you are entitled to a jury of 12.
  6. Sentencing: Last phase in the Nevada DUI arrest process. This is the final verdict imposed by the court after the trial or acceptance of a plea bargain. Sentences may include jail time, in-home detention, public service, alcohol classes and fines.
