Illinois Dui Penalties

  • DUI CONVICTION, AGE 21 & OVER, FIRST CONVICTION
    If you are 21 years old or older and are charged with the 1st Illinois DUI conviction, the penalties are:
    • License – one-year loss of full driving privileges.
    • Jail time – Possible imprisonment for up to one year.
    • Fine – $2,500.
  • DUI CONVICTION, UNDER AGE 21, FIRST CONVICTION
    If you are under 21 years of age and are charged with the 1st Illinois DUI conviction, the penalties are:
    • License – Minimum two-year loss of full driving privileges.
  • SECOND CONVICTION
    If you are charged under the second conviction of DUI in Illinois:
    • License – loss of full driving privileges for a minimum of three years or until reaching age 21.
    • Jail time – up to 1 year.
    • 2nd conviction in the 5-year period – Mandatory 48 hours in jail & 10 days community service.
    • Fine – $2,500.
  • SUMMARY SUSPENSION FIRST OFFENSE:
    • A chemical test indicating a blood alcohol concentration of .08 or greater results in 3-month drivers' license suspension for the Illinois DUI conviction.
    • Refusal to submit to or failure to complete chemical testing results in six-month license suspension.
  • SUBSEQUENT OFFENSE:
    • A chemical test indicating a blood alcohol concentration of .08 or greater results in a mandatory 12-month drivers' license suspension.
    • Refusal to submit to or failure to complete chemical testing results in a mandatory 24-month suspension for a DUI in Illinois.
