What is BAC?
BAC stands for Blood Alcohol Concentration. This is a measure of the alcohol content level in your body to determine if you are can be convicted of an Illinois DUI.
Can I get my case dismissed as my BAC result was below .08?
Not necessarily. The Police can still charge for the Illinois DUI conviction as the citation is up to the officer’s opinion regardless of BAC test result.
How do I distinguish a suspension and revocation?
A suspension refers to losing the driving privileges for a period of time until the reinstatement requirements are met as per the Illinois DUI Law, while a revocation refers to losing the privileges for an indefinite period.
What if I drive while suspended or revoked?
This is a serious offense and results in a mandatory jail time or community service. You may also face forfeiture of the vehicle you were driving. You may be charged with a felony and imprisonment by the court.
How many hours of alcohol classes will I have to take?
Between 10 to 75 hours. This depends on your BAC, driving history,
and certain other factors at the time of Illinois DUI conviction.
Can I get my Illinois DUI case dismissed because I was not read my rights?
Probably not. In cases where you were questioned before being taken into custody, your comments may not be used against you.
What is implied consent and how do I know if I'm a "first offender"?
A "first offender" for implied consent purposes is one who has not had a previous conviction, court supervision, or Illinois DUI suspension within the last five years.
