Police Mistakes


The following list elicits the common mistakes committed by the Police Officers while taking the charge of a Georgia DUI case.


Stopping


Georgia officers conduct a traffic stop for a Georgia DUI:

  • On the basis of an anonymous call without a reasonable belief on the accuracy of that call.
  • Just because the police officer thinks you are suspicious.
  • The vehicle is driven too slowly or has been stopped somewhere.
  • For an improper sign.
  • At an improper roadblock.
  • Just to verify your driver's license and registration with out any traffic infraction.
  • Without identifying the reason for the stop.
  • For no reason at all.


Arrest
A Georgia DUI arrest occurring from an officer detected smell or odor of alcohol. It is not against the Georgia DUI laws to drink and drive. A Georgia DUI conviction occurs only if you have been identified with an unlawful blood alcohol level, or incapability to drive in normal circumstances.
