I have been stopped while driving by a police officer and he asks me to take the field sobriety test. Should I do them?
The police officer has a right to ask you to perform the test. However, you can refuse to take the test. Refusing to take the sobriety test should not result in legal consequence as a refusal cannot be used in a trial.
Is First Offender treatment available for a Georgia DUI case?
No. First Offender treatment is statutorily prohibited for DUI in Georgia.
Is there an imprisonment for Georgia DUI?
DUI has become a very serious issue, and most judges will give jail time for a first offense. A Georgia DUI carries a maximum penalty of 12 months in jail and a minimum period of 24 hours in jail.
How many hours of alcohol classes will I have to take?
There is a 20-hour DUI traffic school that must be taken in order to get your license back on any Georgia DUI conviction. In addition a 17-week course is required on second or third DUI offense within a five-year period.
If I had a DUI in another state, will it show up in Georgia?
Yes, there is a chance DUI/DWI convictions from other states will show up through a automated search. However, this only happens occasionally.
How will this affect my out of state license?
Georgia has no right to suspend an out of state license; it can only revoke the privilege to drive with in the state. Only your home state can suspend your license. However, Georgia is required by law to notify your home state of your DUI in Georgia.
How long does a Georgia DUI stay on my record?
In Georgia, a DUI will remain on your record forever.
Can I represent myself with out hiring a Georgia DUI lawyer?
Every person can choose to represent them self in court. However, since DUI is a critical matter, it is not wise to go to court not represented by a qualified attorney.
Can I plead Nolo or No Contest?
A Nolo plea for offenses prior to July 1, 1997 could save your driver's license but currently it is of very little use and may not save your license.
What is an interlock ignition device?
An Interlock Ignition Device is installed on the steering column of the car and requires a breath sample in order for the car to start. Installation is required depending upon the Georgia DUI conviction.
