Your Legal Rights
Georgia DUI rights are being overlooked. It is very important for drivers to be aware of the following rights they retain during a Georgia DUI:
- Right to stay calm.
- Right to refuse to take any FIELD SOBRIETY TESTS, including the hand held ALCO-SENSOR breath testing device.
- Right to refuse to take any chemical test (blood, breath, urine). If you are under 21, or if this is not your 1st DUI in 5 years.
- Right to exercise the 10 day rule if have been charged with Georgia DUI. If you possess above .08 BAC level on the Chemical Test, or if you refuse the test, you have 10 calendar days in hand to make an appeal for the license.
- Right not to permit the search of your car.
- Right to a Georgia DUI attorney.
