10-Day Rule
If you have been accused of a DUI in Georgia, and you refuse to take a breath, blood or urine test, or if you take the test result is 0.08 or greater; you have 10 business days to request for the cancellation of license suspension and activation.
Failure to appeal with in 10 days results in a one-year suspension of your driver's license as per the Georgia DUI law. This 10-Day rule is applicable in your case if any of the following facts are present in Georgia DUI arrest:
- Blood alcohol level was .08 or higher in the test results.
- You refused to take the test.
- You did try to take the test but was blamed to be a refusal case.
- You have a CDL and blood alcohol level was .04 or higher.
- You are unsure of the BAC level.
