Administrative Suspension & Disqualification Law
Suspension Law
- First Suspension for Driving:
If the blood alcohol level is 0.08 or higher, driving suspension lasts for 6 months.
- Second or Subsequent Suspensions for Driving:
If the blood alcohol level is 0.08 or higher, driving suspension lasts for I year.
- First Suspension for Refusal to Submit to Breath, Urine or Blood Test during DUI in Florida:
Drivers license is suspended for 1 year.
- Second or Subsequent Suspensions for Refusal during Florida DUI:
For subsequent refusals, the license is suspended for 1 year.
Suspension is effective immediately and the officer will issue the driver a temporary permit valid for 10 days from the date of arrest after Florida DUI, provided the driver is otherwise eligible.
Disqualification Law
- First Disqualification for Driving a Commercial Motor Vehicle With an Unlawful Blood Alcohol Level (.04 or above): The Florida DUI defendant’s driving privileges are disqualified for 6 months.
- Second or Subsequent Disqualification of Driving a Commercial Motor Vehicle With an Unlawful Alcohol Level (.04 or above): driving privileges are disqualified for 1 year.
- First Disqualification for Refusal to Submit to Breath, Urine or Blood Test Arising from the operation of a Commercial Motor Vehicle: driving privileges are disqualified for 1 year.
- Second or Subsequent Disqualification for Refusal to Submit to Breath, Urine, or Blood Test Arising from the Operation of a Commercial Motor Vehicle: defendant’s driving privileges are disqualified permanently.
Disqualification occurs immediately upon refusal to take a breath, urine or blood test or upon identifying that the driver has BAC level of 0.08 or above while driving the vehicle. A temporary permit is issued by the Police officer that is valid for 10 days from the date of arrest or disqualification. How ever the Florida DUI defendant is not permitted to drive for the first 24 hours of disqualification.
