UNDER-21 SCREENING TEST REFUSAL (ZERO TOLERANCE LAW)

§ 23136. Zero Tolerance Law; Refusal to Take Screening Test.

(a) If you are under 21, it is illegal to drive a vehicle with a blood alcohol content of .01 or greater, as measured by a preliminary screening or other chemical test.

(c)

(1) If you are under 21 and are lawfully detained for a suspected violation of subsection (a), you are assumed to have agreed to a preliminary alcohol screening test or other chemical test to determine your blood’s alcohol content.

(2) A police officer needs only reasonable cause to believe you were driving under the influence of alcohol in order to submit you to an alcohol test.

(3) If you refuse to submit to or fail to complete a preliminary alcohol screening test or other chemical test, your driver’s license will be automatically suspended for 1 to 3 years.
