SUSPENSIONS FOR SPECIFIED BLOOD ALCOHOL LEVELS

§ 13353.2. Suspensions for Specified Blood Alcohol Levels; Administrative Review; Dismissal of Prosecution.

(a) The DMV will suspend your driver’s license immediately for any of the following:

(1) Your blood alcohol level was over .08;
(2) You were under 21 and had a blood alcohol level over .01;

(b) A police officer or the DMV will give you written notice of the suspension.

(c) The written notice will contain information about the suspension and the process of obtaining an administrative hearing if you want one.

(d) The DMV will review the case and decide whether or not to suspend your driver’s license. Such a decision is final, unless you request an administrative hearing. The decision from the administrative hearing is final.

(e) If you win the administrative hearing and if no criminal charges are brought against you by the City Attorney or District Attorney, the driver’s license suspension is dropped and you get your license back.

(f) The evidentiary reasons why you were not prosecuted by the City Attorney or District Attorney can be written down and given to you.
