License Suspension


Following a California DUI conviction, a Notice-of-Suspension is issued for 30 days. After 30 days you may receive a restricted drivers license. The defendant can contest for the suspension and get the license back if he or his attorney contacts the DMV’s local drivers safety office and demands a trial with 10 days (calendar days).

Sometimes the license privileges are revoked immediately which is referred as an administrative suspension. This is different from the license suspension that happens at a later stage in the local jurisdiction as per the California DUI Laws.


Immediate license suspension can happen in the following scenarios:

  1. having .08% or higher blood-alcohol (.01% for drivers under 21);
  2. providing a blood or urine sample when the officer believes the eventual analysis will be .08% or higher
  3. refusing to take a chemical test for a California DUI.
