INFORMATION ABOUT DRIVER’S LICENSE SUSPENSIONS
§ 13353.3. Effective Date and Period of Suspension.
(a) A driver’s license suspension order is effective 30 days after you are served with written notice of the suspension.
(b) The length of suspensions can vary:
(1) If you have no prior DUI-type convictions for the last 10 years, no testing refusals, and no negative administrative hearing results, your driver’s license suspension can be four months.
(2) If you have been convicted of one or more DUI-type incidents within the last 10 years or have negative administrative hearing results concerning testing refusals within the last 10 years, your driver’s license suspension can be one year.
(3) If you have negative administrative hearing results indicating you have refused chemical testing, your driver’s license suspension can be at least one year.
(c) If you get a DUI while driving on a license that was suspended or revoked because of a DUI-type conviction, suspensions and revocations for multiple sections will be applied and whichever is the longest will be what you get.
