Rights
Possessing the elementary knowledge on the California DUI laws will give a broad understanding of the defendant’s rights when accused of a California DUI. Being aware of your rights will help mitigate most CA DUI cases.
If you are charged with a DUI in California these are your rights:
- You may be represented by a California DUI lawyer in all legal proceedings.
- In case, you cannot afford one, the court will appoint an attorney for you.
- You can have a trial on any DUI charge and specifically a right to a trial by a jury of twelve persons, before you may be found guilty for a California Dui.
- You have the right to subpoena and submit court evidence and witnesses on your behalf, including your right to testify on your own behalf.
- You can cross-examine the witnesses against you.
- You have every right to stay quiet and need not testify yourself.
