DUI THIRD OFFENSE
§ 23546. DUI Third Offense.
(a) If you are convicted of a DUI within 10 years of two previous DUI convictions, you may be punished by 120 days to 1 year in jail and a fine of $390 to $1,000. Your driver’s license will be revoked (see § 13352) and you will have to surrender your license to the court.
(b) If you are convicted under this section, you shall be labeled as a “habitual traffic offender” for 3 years after the conviction (see § 13350).
