DUI SECOND OFFENSE
§ 23540. DUI Second Offense.
(a) If you are convicted of a DUI within 10 years of a previous DUI conviction, you may be punished by 90 days to 1 year in jail and a fine of $390 to $1,000. Your driver’s license will be suspended (see § 13352) and you will have to surrender your license to the court.
(b) If the court determines you are a safety or traffic risk, the court can decide not to grant you a restricted license for employment use.
