California DUI evidence sought under the following categories:
- Blood-alcohol evidence - Generally a breath test but sometimes a blood test.
- Physical symptoms – like slurred speech, or bloodshot eyes.
- Field sobriety tests.
- Incriminating statements – like “I only had six beers.”
- Driving symptoms - like weaving, or lane straddling.
Legal Rights
Ideally, you should be aware of certain legal rights you can exercise when charged of a DUI in California:
- Sufficient legal facts are required to institute a probable cause to stop and arrest you for a California DUI.
- Police officers should advise you of optional submission to field sobriety testing and portable field breath testing is not required by California DUI law.
- Since the breath sample is unsaved after administration, you should be given a chance to obtain a blood sample for later independent testing by your defense attorney.
- You should be allowed to make a choice on breath or blood testing; if you decline, you must be advised of the implied consent
