What is a DUI?

Am I taken in to custody immediately if I lost my trial?

This depends on the conviction, if you are accused of a class 4 felony, you are taken into custody immediately and may have to spend a jail time of 4 months. If you are convicted of a misdemeanor, you can self-surrender yourself to jail on the date of your choice. This may not be more than 30 days after your conviction of Arizona DUI.


Can I be convicted of DUI even if I was not driving the vehicle?
This depends on your position in the vehicle that is where you were in relation to the car. If you had a present ability to move the vehicle you may be charged with Arizona DUI by virtue of being "in actual physical control" of the vehicle.


Can I expunge my Arizona DUI?
No. There is no such provision to the conviction removed from his criminal record in Arizona as per the Arizona Dui law.


Is my DUI a felony?
It is a misdemeanor unless you injure somebody or possess a suspended license at the time of your DUI or had two or more prior DUIs in the last 60 months or had a child in the car at the time of your Arizona DUI.


Is Extreme DUI a felony?

Can I refuse field-testing?
No, this is as per a recent decision taken by the Arizona Court of Appeals, Div 1.


Can I negotiate with the MVD regarding my license suspension?
No. Arizona MVD has nothing to do with suspensions and revocations for Arizona DUI.


When should I install an Ignition Interlock?
You need to do it once your driving privileges have been reinstated in accordance with the Arizona DUI law.
